These Terms and Conditions ("Terms") govern your use of this website (the "Site") operated by Evidence MD Medicine & Aesthetics LLC ("Evidence MD," "we," "us," or "our"). By accessing or using this Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

We may update these Terms from time to time. Your continued use of the Site after we post changes means you accept the updated Terms.

1. Website Content Disclaimer (No Medical Advice)

All content on this Site is provided for general informational purposes only and is not medical advice, diagnosis, or treatment. Reading this Site or contacting us through it does not create a physician and patient relationship. Always seek the advice of a qualified health care professional about any medical condition. If you have a medical emergency, call 911 immediately.

2. Care Requires an In-Person Evaluation

Medical aesthetic treatments are medical procedures. Before any treatment, a qualified Evidence MD provider performs an individualized in-person evaluation, confirms that treatment is appropriate for you, and establishes the plan of care. We do not provide treatment based on an online form alone. Information you submit through the Site helps us prepare for your consultation but does not constitute a clinical evaluation or a prescription.

3. Eligibility (18 and Older)

The Site and our services are intended for individuals 18 years of age and older. We do not knowingly provide services to minors through online booking.

4. Individual Results and Photographs

Results vary. Aesthetic and wellness outcomes are individualized and depend on your medical history, anatomy, and other factors. We treat to a diagnosis and recommend only what the clinical evidence supports, and if a treatment is not indicated for your condition, we will say so. No specific result or outcome is promised or guaranteed.

Before-and-after images. Photographs shown on the Site are examples of possible outcomes and do not guarantee similar results. All images are owned by or licensed to Evidence MD and may not be copied or redistributed without our written permission. If you consent to the use of your own photographs, that consent is handled separately through our intake and consent forms.

5. Appointments, Cancellations, and No-Shows

• No deposit to book. We do not require a deposit to schedule. We may keep a payment card on file and, with your authorization at booking, apply a late-cancellation or no-show fee to that card.
• Cancellation notice. We ask for at least 24 hours' notice to cancel or reschedule. You can cancel or reschedule by phone, text, or your booking link.
• Late cancellations. If you cancel or reschedule with less than 24 hours' notice (a same-day cancellation), a $50 fee applies.
• No-shows. If you do not arrive for your appointment and do not contact us, a $50 no-show fee applies.

6. Refunds and Treatment Packages

• Before a service begins. The cost of a treatment may be refunded before the clinical service is initiated.
• Once a service is initiated. No refunds are issued once a service has begun, including a single treatment or the first session of a multi-session package.
• Package credits. If you cannot complete a multi-session package, the Medical Director may, at the practice's discretion, credit the value of the remaining undelivered sessions toward another treatment plan. Credits are non-transferable.

7. Pricing, Promotions, and Availability

We may modify pricing, suspend promotions, or discontinue services at any time without prior notice. Service descriptions and availability are subject to change, and we may correct errors in pricing or descriptions even after an appointment is booked.

8. Payments

Payment is due at the time of booking or when services are rendered. Card transactions are processed by our secure third-party payment processor, subject to its terms. We do not store full payment-card numbers on our website servers.

9. Memberships and Recurring Billing

• Auto-renewal. Our membership plans are continuous-service subscriptions. When you enroll, you authorize Evidence MD to charge the payment method on file the recurring membership fee on an automatically renewing basis (for example, monthly) until you cancel. Your membership renews automatically at the end of each billing cycle.
• What you agree to at enrollment. The specific membership price, billing frequency, included benefits, and any minimum commitment are disclosed to you at the time of enrollment, and you authorize the recurring charge as part of signing up.
• Cancellation. You may cancel a membership at any time by phone, text, or your booking link. Cancellation stops future renewals and takes effect at the end of the current paid billing cycle. Fees already billed for the current cycle are not refunded, and your membership benefits remain available through the end of that cycle.
• Changes to pricing or benefits. We will give you advance notice of any change to your recurring fee or membership benefits, and you may cancel before the change takes effect if you do not agree to it.
• Failed payments. If a recurring charge cannot be processed, we may pause membership benefits until the balance is current.

10. Text Message (SMS) Program and Consent

If you opt in, you may receive text messages from Evidence MD, including appointment confirmations, appointment reminders, practice updates, and, if you separately opt in, promotional offers. Consent to receive marketing text messages is not a condition of purchasing any goods or services.

The consent you give at sign-up reads:

Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for help. If you opt out and later want to rejoin, opt in again through the form on our website. Carriers are not liable for delayed or undelivered messages.

Mobile opt-in data and consent are never shared with or sold to third parties or affiliates for marketing or promotional purposes. How we handle your information is described in our Privacy Policy.

11. Communications and Website Security

Email and web forms may not be encrypted. Please do not submit highly sensitive medical information through these channels. Your use of the Site is also governed by our Privacy Policy, and, if you are a patient, by our Notice of Privacy Practices, which describes how we handle Protected Health Information under HIPAA and Oregon law.

12. Intellectual Property

All text, logos, graphics, and design elements on the Site are the property of Evidence MD Medicine & Aesthetics LLC. You may view and print pages for personal, non-commercial use only.

13. Limitation of Liability and Indemnification

To the maximum extent permitted by law, Evidence MD is not liable for damages arising from your use of the Site. You agree to indemnify and hold harmless Evidence MD Medicine & Aesthetics LLC, its providers, and its staff from claims or expenses arising out of your violation of these Terms. Nothing in these Terms limits any liability that cannot be limited under applicable law.

14. Governing Law (Oregon)

These Terms are governed by the laws of the State of Oregon. Any dispute arising from these Terms or your use of the Site shall be brought in the state or federal courts located in Multnomah County, Oregon, and you consent to their jurisdiction.
